Will vs. Trust: What’s the Difference?
From Asset Distribution to Long-Term Wealth Management
When considering wealth succession, one of the first questions many people ask is:
“If I have a will in place, isn’t that enough?”
Both a will and a Trust can play important roles in succession planning, but they are designed to address different needs.
A will primarily addresses:
How should a person’s assets be distributed according to their wishes after death?
A Trust goes a step further:
Once assets enter the succession process, how should they be held, managed and distributed over the next ten or twenty years—or even across future generations—in accordance with defined objectives?
For entrepreneurs and high-net-worth families, therefore, the question is often not simply who receives the assets, but how those assets should continue to be managed over time.
As family wealth expands across business interests, financial assets and multiple jurisdictions, succession planning can become increasingly complex.
Entrepreneurs and families may need to consider questions such as:
How should assets be managed if the next generation is not yet ready?
If beneficiaries are still young, would receiving substantial assets at once be consistent with the family’s long-term objectives?
How can ownership of a family business be preserved across generations?
As business interests pass to future generations, how can families address governance challenges that may arise as ownership becomes increasingly fragmented?
How should cross-border assets be managed over the long term?
When family members, financial assets, real estate or businesses are located across different jurisdictions, how can a more sustainable management framework be established?
Who should manage the assets if the individual can no longer do so personally?
Wealth planning may need to consider not only arrangements after death, but also circumstances involving ageing, incapacity or an inability to continue managing assets personally.
How can both wealth and family values be carried forward?
Succession is not simply about transferring assets. It can also involve preserving family responsibilities, entrepreneurial values and a shared long-term vision.
These issues often cannot be fully addressed through a will alone.
A simple way to understand the distinction is:
A will primarily addresses how assets are distributed.
A Trust can go further by addressing how assets continue to be managed.
The two are not necessarily substitutes for one another, nor does succession planning always require choosing one over the other.
Within a comprehensive family wealth and succession framework, wills, Trusts, business ownership arrangements, insurance, investment structures and other tools may each serve different purposes depending on the family, the location of its assets and its long-term objectives.
The starting point is therefore not the instrument itself, but an understanding of what the family ultimately wants to achieve.
For entrepreneurs, perhaps the more important question is not simply:
“How much wealth do I want to leave behind?”
It is also:
“When I am no longer personally managing these assets, according to what principles should they continue to be managed?”
How should the family be provided for?
How should the next generation be supported?
How can stability in business ownership and governance be maintained?
How can younger family members understand the responsibilities that accompany wealth?
And how can the family’s values and entrepreneurial spirit continue across generations?
When succession planning moves beyond asset distribution toward long-term intergenerational management, Family Offices, Trusts and family governance can begin to play a broader role.
At ASJ Global Group, we believe succession planning should not begin with a particular financial or legal instrument. It should begin with the long-term objectives of the family, its businesses and its assets.
For families with business ownership, cross-border assets or multiple generations of family members, it is particularly important to consider the relationship between wealth ownership, business succession, family governance and next-generation participation as part of an integrated framework.
Through our international financial and professional network, ASJ works with entrepreneurs and families to identify their cross-border needs and connect with trust institutions, private banks, legal advisers, tax professionals and other specialists to evaluate succession structures aligned with their long-term objectives.
Businesses need to be managed. Wealth needs to be managed. And succession needs to be planned well in advance.

Trust
遺囑主要處理「如何分配」;
Trust
ASJ Global Group
